TERMS OF USE AGREEMENT

(“GREO”)

And

(the “Data User”)

WHEREAS a purpose of the GREO Evidence Centre is to retain, preserve and make accessible Datasets arising from research in the field of problem gambling;

AND WHEREAS the Data User intends by entering into this Agreement to access material from the Evidence Centre for the purpose of research subject to the terms and conditions herein;

NOW THEREFORE the undersigned parties agree as follows:

1. INTERPRETATION

In this Agreement “Dataset” means the electronic file or files containing research data, and the supporting documentation sufficient to make that data useable.

The Schedules attached hereto form part of this Agreement.

This Agreement shall be governed by and interpreted in accordance with the laws of the Province of Ontario.

2. ACCESS TO DATASETS

GREO hereby grants the Data User access to Datasets within the Evidence Centre which are categorized as open.

Where the Data User has submitted a “Request to Access Restricted Data” application, in the form attached hereto as Schedule A, and GREO has approved the request in whole or in part, which shall be attached as Schedule B, the Data User shall have access to the restricted data as outlined therein.

Data Users approved for access to restricted data will be required to register with the Scholars Portal Dataverse Network and select a login name, which shall be provided to GREO and included at Schedule B.

3. ACCEPTABLE USE

A Dataset or any part of a Dataset shall only be used for the purposes of not-for-profit research, study, or personal educational development, except where the Data User has obtained the express written permission of GREO, which shall be subject to the approval of the copyright owner.

4. PROHIBITED USES

A Data User shall not:

(a) seek to obtain further information about, or initiate contact of any nature whatsoever with, individual subjects identified or identifiable in the Dataset;

(b) produce links within Datasets or between data and other Datasets that could identify individuals, institutions or organizations;

(c) redistribute Datasets in whole or in part to other individuals, institutions, or organizations, except those named in the Request to Access Restricted Data application form and included in the approval by GREO attached at Schedule B; or

(d) directly or indirectly, in any publication arising from use of the Dataset, identify an individual who has become known to the Data User as a result of access to the Dataset.

(e) use information contained in the Dataset for commercial purposes or financial gain.

In the event that the Data User breaches any of the above conditions of use, which GREO may determine at its sole discretion, GREO shall have the right to immediately suspend or terminate the Data User’s access to GREO Evidence Centre services, as well as pursue any other available remedies available at law.

5. DATA USER RESPONSIBILITIES

The Data User shall acknowledge the Dataset Depositor(s) in any publication, whether printed, electronic or broadcast, which is in whole or in part derived from the Dataset, and shall further provide a link and reference the source of the original Dataset, using the citation provided.

The Data User will respect all restrictions identified in the Dataset(s).

The Data User will promptly inform GREO of any errors discovered in any part of the Dataset.

The Data User will immediately advise GREO if he or she becomes aware that the identity of any individual has been inadvertently revealed.

6. SECONDARY ANALYSIS

The Data User agrees to make available for deposit to the Evidence Centre any new dataset(s) developed and/or derived from the Data User’s secondary analyses of an existing Dataset.

The Data User further agrees to make available for deposit in a GREO repository of related publications any citations of published work or references based on an existing Dataset, and will where possible also make the published works available for deposit.

The deposit of the derived materials will include sufficient explanatory documentation to enable accessibility to other Evidence Centre users.

7. INTELLECTUAL PROPERTY

The Data User hereby acknowledges and agrees that access to the Dataset(s) does not convey to the Data User any intellectual property or other proprietary rights in the Dataset(s).

8. DISCLAIMER

The Data User acknowledges and agrees that the role of GREO is limited to the operation and maintenance of the Evidence Centre, and as such GREO offers no warrantee or assurance, express or implied, as to the accuracy, completeness, or reliability of the Datasets in the Evidence Centre. Any and all uses and/or interpretations of the Datasets, or inferences arising from such use or interpretation, are neither monitored nor endorsed by GREO.

9. INDEMNIFICATION

The Data User indemnifies and holds harmless GREO and its employees, agents, directors, officers and successors and assigns from and against any and all losses and expenses of whatsoever nature or kind, including of and from all manner of actions, causes of action, suits, contracts, claims and demands whatsoever to which GREO is or may become liable, arising out of or as a consequence of (i) the negligent acts, errors or omissions including, without limitation, breaches of copyrights and other proprietary rights, and privacy rights, and/or (ii) any breach of this Agreement including its Schedules, on the part of the Data User.

Confidentiality: The ENHJEU-QUÉBEC Research Team has taken great care to protect the identity of participants and to safeguard their privacy and the confidentiality of the data they provided. Any secondary analyses undertaken using these data must also maintain the confidentiality of these data. To assure confidentiality, the data provided to Data Users will be stripped of all identifiers including original ID numbers.

Data Security: The ENHJEU-QUÉBEC data set(s) must be s tored in a password-protected location. Giving access to or sharing/transferring the database to individuals not named in the Request Form, or using ENHJEU-QUÉBEC data for purposes not described in the approved Request Form is considered a serious and unacceptable breach of the agreement between the ENHJEU-QUÉBEC Research Team and the Data User. If data are passed on to anyone not named in the Request Form, or if data are used for purposes other than those described in the approved Request Form, the ENHJEU-QUÉBEC Research Team will request the immediate return of the data.

Application for ENHJEU-QUÉBEC Data: Access to data collected in 2012 ENHJEU-QUÉBEC survey is open to individuals with researcher status as defined in the FQRSC general rules and regulations document (http://www.fqrsc.gouv.qc.ca/upload/editeur/common-rules.pdf) (“Researcher Status”). According to the FQRSC regulations, Researcher Status is recognized for applicants who have a doctoral degree (or the equivalent) an d have a regular position as a professor/teacher or researcher in a Québec university or college or else have a regular position as a researcher in an institution within Québec's health and social services network. MSc, PhD, and Postdoctoral students may apply for use of the data with the support and supervision of their primary supervisor. In order to obtain access, applicants must submit an electronic copy of the Request for ENHJEU-QUÉBEC Data Application Form (the “Request Form”) to the ENHJEU-QUÉBEC Research Team.

Review of Proposal: Receipt of the Request Form will start the review process by the ENHJEU-QUÉBEC Research Team. Approval will be based on the absence of overlap with other ongoing projects and relevance. The review process will produce one of two outcomes – acceptance or rejection. Results of the review (including conditions (i.e., adding investigators), recommendations, and/or reason(s) for rejection) will be communicated by email to applicants. Approval of a Request Form will g ive access to the public data file in which some variables have been aggregated to preserve the anonymity of participants. Access to non-aggregated information from the “Master file” may be given for individual projects. Still, master files do not include any nominal information. In this case, researchers requesting such access must justify the need for this data for project completion. Data Users will/may be requested to provide a certificate of ethics approval from their institution’s Institutional Research Board.

Data User Agreement Form: After approval of the Request Form, all persons named in the Request Form must sign the “Data User Agreement Form”.

Need for Additional Variables: If the Data User needs variables that are not described in the approved Request Form, they must submit a request by email to the ENHJEU-QUÉBEC Research Team explaining the need for new variables, what new analyses will be undertaken, and if this addition changes the timeline described in the original Request Form. Under no circumstances may Data Users conduct analyses outside the mandate of the approved Request Form. If Data Users wish to conduct a new/di fferent analysis or use data for reasons other than those described in the original Request Form, they must submit a new Request Form to the ENHJEU-QUÉBEC Research Team.

Progress Reports: The ENHJEU-QUÉBEC Research Team may ask for a brief progress report at the mid-term of the project.

Date of Project Completion: Applicants must indicate a project completion date on the Request Form. If the expected publications, abstracts, or reports are not submitted to the ENHJEU-QUÉBEC Research Team by the completion date indicated, the data will revert to the ENHJEU-QUÉBEC Research Team and the topics on which the Data User has worked will become available for others to use. If applicable, Data Users may submit a request for extension of the project completion data to the ENHJEU-QUÉBEC Research Team explaining why additional time is needed. An exceptional and well-justified request for extension of the project completion date will be considered on a case by case basis.

Final Report: Data Users must submit a short final report to the ENHJEU-QUÉBEC Research Team that lists all documents/products that have been produced (i.e. manuscripts, publications, reports abstracts, ppt presentations, etc). Copies of all project products must be included in the report.

Return of the Database and the code used to analyze the data: ENHJEU-QUÉBEC databases, including the programming code (SPSS, STATA, or any other statistical software) used to analyze the data, must be returned to the ENHJEU-QUÉBEC Research Team upon project completion (i.e. immediately upon publication of the manuscript emanating from the analysis), along with a completed end-of-project form signed by the researcher who made the initial request for access to data. Databases and codes will be stored intact by the ENHJEU-QUÉBEC Research Team for five (5) years after project completion.

Cost Recovery: Depending on the complexity of the request Data Users may be asked to pay for the preparation of databases (programming time).

Publication: In the case of peer reviewed publication, Data Users must submit a pre-publication copy of the manuscript to the ENHJEU-QUÉBEC Research Team. This will ensure that the Team can communicate with the Data User should there be any issues prior to publication. In the case of non-peer reviewed dissemination, the Data User must send a pre-submission copy and the Team reserves the right to request amendments. If there are questions or issues that arise, the ENHJEU-QUÉBEC Research Team may ask for the programs used to analyze the data and may decide to re-analyze it.

Ownership of ENHJEU-QUÉBEC Data: The principal investigator (S. Kairouz) and Co-Investigator (L. Nadeau) who are piloting the ENHJEU-QUÉBEC Study are the rightful owners of the intellectual property associated with the data, research outcomes and results that will be derived from the ENHJEU-QUÉBEC Study (http://www.fqrsc.gouv.qc.ca/upload/editeur/common-rules.pdf)). Data Users do not own the data.

IRB Approval: Data Users of data from the “Master file” that is not availabl e in the public file will/may be requested to provide a certificate of ethics approval from their institution’s Institutional Research Board.

The Data User must agree to:

1. Cite the ENHJEU-QUÉBEC project in any and all manuscripts, publications, reports, abstracts, etc. as follows: “The data used in this analysis were drawn from the Portrait des joueurs au Québec: Prévalence, incidence et trajectoires sur 4 ans (ENHJEU-QUÉBEC) study, which was funded by the Fonds québécois de la recherche sur la société et la culture.”

2. Not transfer data to any individual not named in the approved Request for ENHJEU-QUÉBEC Data Application Form (“Request Form”).

3. Store ENHJEU-QUÉBEC database(s) in a password-protected location.

4. Not merge data files.

5. Not link/decrypt ID numbers.

6. Not conduct any analysis outside the mandate of the approved project.

7. Return ENHJEU-QUÉBEC data to the ENHJEU-QUÉBEC Research Team upon project completion or on the project completion date as recorded in the Request Form.

8. Produce progress reports periodically on request by the ENHJEU-QUÉBEC R esearch Team.

9. Submit the final version of all manuscripts to the ENHJEU-QUÉBEC Research Team for endorsement by the ENHJEU-QUÉBEC investigators BEFORE publication.

10. Provide a list of all presentations, posters, manuscripts and publications.

11. Provide a copy of the codes used to analyze the data to the ENHJEU-QUÉBEC Research Team.

12. Read and comply with Section 3 “Privacy and Confidentiality” of the Tri-Council Policy Statement: Ethical Conduct for Research Invol ving Humans"
